Do you need a will?

Yes if you:

​

• Own a property

• Have extensive assets

• Have a family trust, business or company

• Want to leave assets to certain people (or exclude others)

• Want to donate to charity

What is probate?

Probate is the administration of your estate by your executor and trustee following your passing.  Your assets and debts are managed and your net estate is then distributed to your beneficiaries in accordance with your will.

 

If you have an estate worth over $113,000 then your executor applies for a Grant of Probate.  This is a legal document that certifies that your Will is valid and can be acted upon. 

 

If you don't have a will and your estate is large, an interested person can apply for Letters of Administration to administer the estate.
